Terms and Conditions

These terms apply to the Card Game Builder (CGB) desktop app, the license keys sold for it, and this website. By downloading or using the app, buying a license, or using the website, you agree to them. If you don’t agree, please don’t use the app or the website.

CGB is made and sold by Telery Limited, a company registered in England and Wales.

The app and the free trial
- You can download and use CGB free of charge for 30 days. No sign up is needed, and the trial has every feature of the paid app.
- When the trial ends, the app keeps working. You can still open, edit and save your projects without restriction, but exported images carry a watermark, and PDF and SVG export are unavailable until you enter a license key.
- We may change, update or discontinue the app or any part of it at any time. Versions you have already installed will keep working.
Your license
When you buy a license key we grant you a personal, non-exclusive, non-transferable license to install and use CGB on devices you own or control, on macOS and Windows.
- A license key is for you (or, if bought by an organisation, for one named user). Don’t share it, publish it, sell it or give it away.
- Keys have a fair-use limit on the number of times they can be activated. If you run out of activations because you’ve reinstalled or changed machines, email us and we’ll sort it out.
- Keys from purchases that are later refunded, disputed or charged back stop being valid, and the app will refuse to activate them.
- You may not reverse engineer, decompile or tamper with the app, or try to bypass the license check or the watermark.
Updates
- Your key covers every version of CGB released within 12 months of the date you bought it.
- After those 12 months, the versions you already have keep working with no restrictions. To use versions released later you’ll need to buy a new key.
Payment and refunds
- License keys are sold through Gumroad. Your purchase is also subject to Gumroad’s terms and privacy policy, and Gumroad handles your payment details - we never see them.
- Refunds are processed by Gumroad, and our refund policy matches theirs. To request one, contact us at mail@cardgamebuilder.com or use Gumroad’s own refund process. A refunded key stops working.
- Prices are shown on Gumroad at the time of purchase and may change. Any change won’t affect a purchase you’ve already made.
Your content
- Everything you create with CGB - templates, cards, decks, rules, artwork and exported files - belongs to you. You can use it however you like, including in games you sell.
- The starter templates, sample images and fonts bundled with the app may be used freely in the games you make with it.
- CGB works offline. Your projects stay on your own computer and are never uploaded to us.
Other people’s rights
- The license covers the software, not the content you put into it. You are responsible for having the right to use any artwork, text, names, logos or card designs you include in your cards, and for complying with the law in your country.
- Don’t use CGB to infringe anyone’s copyright or trademarks, or to create content that is unlawful. Making a few replacement components or playtest proxies for your own personal use is fine - see our FAQs - but be respectful of the original creators, and don’t sell other people’s work.
Warranty
CGB is provided “as is”. We work hard to make it reliable, but we don’t promise that it will be error-free, uninterrupted, or suitable for any particular purpose. Software can lose data - please keep backups of your .cgbz project files.
Limitation of liability
To the fullest extent permitted by law, Telery Limited is not responsible for any loss or damage arising out of your use of, or inability to use, the app or this website. That includes, without limitation:
- loss of, or damage to, data or projects;
- loss of profits, revenue, business or goodwill;
- the cost of printing, manufacturing or shipping cards or games, including where the printed result differs from what you expected;
- any indirect, incidental, special or consequential loss.
Where liability can’t be excluded, our total liability to you for all claims relating to the app or a license is limited to the amount you paid us for that license.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be excluded by law, and nothing in them affects your statutory rights as a consumer.
Indemnity
You agree to indemnify and hold harmless Telery Limited, and its directors and employees, against any claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your use of the app or website, the content you create or distribute with it, or your breach of these terms - in particular any claim that content you produced infringes someone else’s intellectual property or other rights.
Ending the license
We may end your license if you seriously breach these terms - for example by sharing keys or bypassing the license check. If that happens you must stop using the paid features of the app.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed, and the current version is always at cardgamebuilder.com/terms. Continuing to use the app or website after a change means you accept the new terms.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute - except that if you are a consumer living elsewhere, you keep the protection of any mandatory rules of your own country’s law, and may bring a claim in its courts.
